TERMS OF USE - MYWORKPLACE WEB PORTALS AND MOBILE APP (SYSTEM)
ACCEPTABLE USAGE: Unless otherwise specified, this site is for your personal use. You may not modify, copy,
distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any
information, software, products, or services obtained from this site.
BENEFIT ENROLLMENT REQUESTS: As a condition of your use of the MyWorkplace system, you understand and agree that all
benefit elections made are considered REQUESTS ONLY. You understand and agree that no coverage exists for the benefit
requests you make until your request/application is approved by the underwriting insurance carrier(s) and/or benefit
provider(s) of the policy(s) for which your request was made. You further understand and agree that your benefit
request(s) DO NOT guarantee coverage will be approved by said carrier(s) and/or benefit provider(s) and are subject to
the terms, conditions, and underwriting criteria of those carriers/vendors.
NOTICE OF RIGHT TO MAKE BENEFITS REQUESTS THROUGH ALTERNATIVE METHODS: You have the right to NOT USE the MyWorkplace
system and make benefit requests manually using paper forms/applications. To make your benefit requests manually, please
contact your benefits department for assistance.
BENEFIT INFORMATION: You understand and agree that all data presented about various benefit plans in MyWorkplace
systems is for informational and/or illustrative purposes only and is not binding on your employer, plan sponsors,
carriers, and benefit providers. Should discrepancies exist between the benefit plan data presented and the actual
policies, master policies, and/or certificates of coverage, then these documents override all benefit information
presented in MyWorkplace. If you believe a discrepancy in the benefit data presented exists, please contact your
benefits department immediately.
BENEFIT RATES, EFFECTIVE DATES, and TERMINATION DATES: You understand and agree that all rates, effective dates, and
termination dates presented about various benefit plans in MyWorkplace system are for illustrative purposes only. The
rates, effective dates, and termination dates presented are based on the latest information available at the time data
was presented to you. Should discrepancies exist between the benefit plan rates, effective dates, and/or termination
dates presented and the rates, effective dates, and/or termination dates defined by the benefit plan carriers and/or
providers, then the rates, effective dates, and/or termination dates defined by the benefit plan carriers and/or
providers shall take precedence. If you believe a discrepancy in the benefit plan rates, effective dates, and/or
termination dates presented exists, please contact your benefits department immediately.
ELECTRONIC SIGNATURE AND AUTHORIZATION: The MyWorkplace system will require you to verify your requests, answer
underwriting questions, and/or agree to certain items throughout the system. You understand and agree to use either an
onscreen entered physical signature or a system issued electronic code (PIN) for said authorizations/answers/agreements
and that either of these electronic signature formats shall be considered as valid as your written signature put to a
paper document and certify your authorizations, answers, and agreements made by you during the use of the MyWorkplace
system.
SECURITY OF PERSONAL LOGIN INFORMATION: You understand and agree that your personally created password is your
responsibility to maintain in confidence and that providing this information to other individuals is done at your own
risk. If you feel that an unauthorized person has obtained access to your profile, immediately log on to MyWorkplace
system, change your password, then contact your benefits department for assistance.
NO UNLAWFUL OR PROHIBITED USE: As a condition of your use, you will not use the MyWorkplace system for any purpose
that is unlawful or prohibited by these terms, conditions, and notices. You may not attempt to gain unauthorized access
to any MyWorkplace system, other accounts, computer systems or networks connected to any MyWorkplace system, through
hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information
through any means not intentionally made available through the MyWorkplace system.
IN NO EVENT SHALL MYWORKPLACE INC., THE DEVELOPER OF MYWORKPLACE SYSTEMS AND/OR ITS EMPLOYEES , OFFICERS, VENDORS
AND/OR SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES
WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY
CONNECTED WITH THE USE OR PERFORMANCE OF THE MYWORKPLACE SYSTEM, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES
AND RELATED GRAPHICS OBTAINED THROUGH THE MYWORKPLACE SYSTEM, OR OTHERWISE ARISING OUT OF THE USE OF THE MYWORKPLACE
SYSTEM, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF MYWORKPLACE INC. OR ANY OF
ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE
EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE MYWORKPLACE SYSTEM, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND
EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE MYWORKPLACE SYSTEM.
